In August 2015, Bavaria introduced the rent brake, which also applied in Munich. After a revision by the Bavarian government, the rent brake has been back in effect since August 2019.
How does the rent brake work?
Answer: When re-renting an existing apartment, the rent may not exceed the local comparable rent by more than 10 percent. This comparable rent is determined by Munich's qualified rent index.
The rent brake does not apply when: * A new apartment is rented for the first time. * The apartment was modernized recently, and the modernization costs are passed on to the tenant. * The rent is increased by more than 10% compared to the previous rent of the same apartment. * The landlord can prove that the rent is still significantly below the comparable local rent.

- New buildings When renting out a newly constructed apartment for the first time, there is no rent control.
- Modernization: Following extensive modernization measures, the rent may also exceed the limit. This applies if at least one-third of the costs for a comparable new build apartment has been invested, minus pure maintenance costs.
- File protection If the rent was already above the local comparable rent before re-renting, the landlord may maintain this price. The landlord must provide written proof of the previous rent.
What rent increases are allowed?

During an ongoing tenancy, rent increases are only permitted up to the locally customary comparable rent. In Munich, there is a cap of 15 percent within three years. This cap also applies if the rent has not been increased for more than three years. Rent increases due to modernization measures are excluded from this cap.
