Limits and Freedoms: The Interaction of Rent Controls and the Real Estate Market

In August 2015, the rent control cap was introduced in Bavaria and thus also in the state capital. However, the Munich Regional Court declared this to be insufficiently justified at the end of 2017, as it was not clearly explained why the Munich housing market should be classified as tight. Following corresponding adjustments by the Bavarian state government, the rent control cap came into force again in August 2019, this time covering the entire city of Munich. But what other options for rent adjustments exist, and under what conditions? Key aspects are examined below.

When re-letting existing properties, the rental price may not exceed the local comparative rent by more than 10 percent, based on the qualified rent index.

Exceptions to the rent cap:

  • New buildings There is no upper price limit for the initial letting of newly built apartments. Landlords have the option to independently determine the rents of newly constructed apartments without the restrictions of the rent control cap, in accordance with Section 556f, Sentence 1 of the German Civil Code (BGB). This specifically concerns apartments that are first occupied, rented, and brought to the market after the cut-off date of October 1, 2014, as defined in Section 556g, Paragraph 1a, No. 3 BGB.
  • Modernizations: Landlords are permitted to pass on the costs of extensive modernization work (not to be confused with pure maintenance) to tenants to a certain extent. A property is considered „comprehensively modernized“ if the investment reaches at least one-third of the construction costs for a new building, minus the maintenance costs.
  • File protection Existing rental agreements do not fall under the rent control. In the case of re-letting, a landlord may keep the previously charged rent, but must prove the rent amount of the previous tenancy.

Permissible rent increases
Within existing tenancy agreements, an adjustment up to the local comparative rent is possible, though limited to a maximum of 15 percent over three years in Munich. This does not apply to rent adjustments due to modernization.

Market developments in the rental housing market
The rental market, especially the new construction sector, is experiencing a sharp rise in rental prices, driven by increased demand for rental properties as a result of rising interest rates and inflation. High-earning professionals from the tech sector in particular, so-called high potentials, are boosting demand in the high-priced rental segment in and around Munich. Munich-Neuhausen, together with the district of Nymphenburg lying to the west of it, forms Munich's 9th city district. To the east is the inner city fringe of Munich. Neuhausen used to be a rural village with an unfavorable location. Nothing of that can be felt today. The connection to the A8 motorway and a section of the Mittlerer Ring, as well as the U1 subway line toward the large Olympia-Einkaufs-Zentrum, ensure a good private and public transportation network.

The Donnersbergerbrücke is one of the busiest routes in Europe. Very high traffic volumes are also to be expected along Landshuter Allee.

It took about 500 years for the former village to become a thriving district. Today, many companies, primarily in the trade and services sectors, have settled along Landshuter Allee and Arnulfstraße. In addition, Munich-Neuhausen is home to numerous public and important social institutions.

The cityscape of Munich-Neuhausen is reflected in much old building stock and, on the other hand, modern glass buildings. Here you can find architecture that ranges from its founding to today's modern times. The old Winthir Church is a witness of the former village and the Sacred Heart Church represents modern architecture.

Residential and commercial buildings from the period before the First World War define the cityscape along Nymphenburger Straße and around Rotkreuzplatz. The side streets around the square are quiet and offer plenty of greenery with stately, old-style apartments.

Spacious residential areas with cooperative apartments are located in the Arnulfstraße and Donnersbergerstraße area. Arnulfpark has been created behind the Donnersbergerbrücke, an area with completely new residential and office buildings.

The lively and urban city center of Rotkreuzplatz invites you to stroll, shop, and enjoy yourself at its small stalls or street cafés. Munich-Neuhausen boasts a diverse pub culture anyway.

The proximity to Nymphenburg Palace with its large park, the Hirschgarten, and the Nymphenburg Canal ensures ample recreation whether in summer or winter.
